Around 38 states and the District of Columbia have adopted “one-party consent” laws, permitting individuals to record phone calls and conversations to which they are a party or when one-party consent to record the communication.

Around 11 U.S. states require the consent of every party to record a phone call or conversation to ensure that it is being recorded lawfully. The states that have adopted the “two-party consent” are:

These restrictions have caused private investigators to have to work with local and state police forces in order to obtain the legal cover needed to conduct their investigations.

Despite the prohibition on recording telephone conversations, in most jurisdictions, private investigators are legally able to eavesdrop on, and record, conversations that occur in public. These conversations are usually not considered by the courts to maintain the expectation of privacy, and as such is open to all to overhear and record.
